These Terms of Use govern your access to and use of the services provided by Sukhi Inc. ("Sukhi," "we," "us"), including the Sukhi platform and Ana, our AI wellness companion (together, the "Services").
Sukhi provides structured, clinically-informed wellness programs and an AI companion, Ana, built on evidence-based therapeutic frameworks. The Services are for educational and informational purposes and are not a substitute for professional medical or mental health treatment, diagnosis, or crisis intervention. Ana does not diagnose conditions and will direct you to emergency services or crisis resources when appropriate — she is not a replacement for them. If you are experiencing a medical or mental health emergency, contact 911, the 988 Suicide & Crisis Lifeline, or your local emergency services immediately.
You must be 18 or older to use the Services. If you're accessing Sukhi through your employer or health plan, your access is also subject to any additional terms between Sukhi and that organization.
You retain ownership of anything you submit — journal entries, messages to Ana, and similar content. You grant Sukhi a limited license to use, store, and process that content solely to provide, maintain, and improve the Services. We do not use your personal content to train models on behalf of, or share it with, other users or organizations.
You agree not to: harass or abuse others; upload malware or attempt to compromise the Services; scrape or extract data from the Services; submit false or misleading information; or use the Services for any unlawful purpose.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUKHI'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID SUKHI IN THE 12 MONTHS PRECEDING THE CLAIM, OR $20 IF YOU PAID NOTHING.
You agree to indemnify and hold Sukhi Inc. harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Services.
Sukhi does not guarantee any specific mental health, wellness, or clinical outcome. Use of the Services does not create a doctor-patient, therapist-client, or other professional treatment relationship between you and Sukhi.
Sukhi may suspend or terminate your access to the Services at any time for violation of these Terms, at our discretion.
These Terms are governed by the laws of the State of Washington. Any dispute arising from these Terms or the Services will be resolved through binding arbitration administered by JAMS in King County, Washington, except that either party may bring an individual claim in small claims court. Claims must be brought within one year of when they arose.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sukhi regarding the Services.
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
